Nobody ever wants to hear that a loved one they cared about passed away as a result of severe injuries sustained in a car accident. The emotional and financial devastation that can be inflicted on a family can often be the result of the chaotic aftermath that follows a fatal car accident.
When a person sustains injuries as a result of a car accident that was caused by another driver's negligence, that person has the legal right to file a personal injury lawsuit against the driver who was negligent. They may be eligible to receive compensation for any unpaid medical bills, loss of wages due to an inability to return to work, property damage, emotional distress, and physical pain and suffering.
However, if the victim passes away as a result of the injuries sustained in the accident, their surviving family members can file a wrongful death claim on behalf of their deceased loved one who was killed in a car accident. In this manner, the family of the deceased makes an effort to secure the justice and compensation that, had their loved one survived, they would have been able to pursue in another manner.
In addition, a family will have the opportunity to bring claims in a lawsuit for wrongful death, which will enable them to receive compensation for the financial and emotional losses they have endured as a result of the passing of their loved one.
